If you’re a for-hire interstate motor carrier, the Federal Motor Carrier Safety Administration (FMCSA) requires you to designate a process agent in each state you operate in by completing a BOC-3 form. But as a carrier, you’re not allowed to file this form on your own — DOT process agents must file it for you. Form BOC-3

The BOC-3 designates a person or an office to accept any legal papers on your behalf. You’re required to have a designated person or office for each state you operate in before certain federal operating authorities can be granted.

A process agent is a representative responsible for accepting legal documents that may be served against a motor carrier, broker, or freight forwarder. Process agencies must employ or lease the services of individuals or entities within each state and be federally registered with the FMCSA in order to be able to grant a BOC3.

Process Agent BOC-3 Filing Service FAQs

The FMCSA requires all for-hire motor carriers to designate a process agent in each state in which they operate by completing a BOC-3 form. Carriers are not allowed to file the form on their own. A DOT process agent must file it on their behalf.

The Federal Motor Carrier Safety Administration (FMCSA) requires all motor carriers, brokers, and freight forwarders to have a BOC 3 on file with the FMCSA in order to get your authority granted. A BOC Filing is also required in order to reinstate an MC or FF number that has been revoked.
