Third parties may now administer CDL knowledge tests

The FMCSA has reversed course and is now allowing third parties to administer knowledge tests to commercial driver’s license (CDL) applicants.
The agency has reworded its official guidance for 49 CFR §383.75, which since 1993 has prohibited states from allowing third parties to perform knowledge testing without a state official present.
The FMCSA says it reviewed the guidance and decided that it does not have the authority to prohibit third-party testing. The agency is, however, encouraging states to ensure third-party knowledge testers meet the same standards as state examiners as found in §384.228.
The new guidance went into effect on February 3, 2022.
