It’s time to look ahead to 2024 poster updates

The New Year will be here before we know it, and its arrival brings the need for updated labor law posters.
More than 20 states have mandatory posting changes taking effect on January 1, 2024. These changes are required under state laws, and provide employees with the latest information on topics such as:
- Minimum wage rates,
- Leave laws,
- Discrimination protections, and
- Veterans’ benefits.
Will my state poster change?
Employers in states listed below should be ready to display these updated posters on January 1:
- Alaska: Minimum Wage
- Arizona: Minimum Wage
- California: Minimum Wage, Paid Sick Leave
- Colorado: Colorado Overtime & Minimum Pay Standards Order (COMPS Order)
- Connecticut: Minimum Wage; Paid Sick Leave
- Illinois: Your Rights Under Illinois Employment Laws; Paid Leave for All Workers
- Maine: Minimum Wage; Regulation of Employment; Veterans’ Benefits and Services
- Maryland: Minimum Wage
- Massachusetts: Paid Family and Medical Leave
- Michigan: Minimum Wage
- Minnesota: Minimum Wage; Veterans’ Benefits and Services
- Missouri: Minimum Wage
- Montana: Minimum Wage*
- Nevada: Domestic Violence Bulletin
- New Jersey: Minimum Wage
- New York: Minimum Wage
- Ohio: Minimum Wage
- Rhode Island: Minimum Wage
- South Dakota: Minimum Wage
- Vermont: Minimum Wage
- Washington: Paid Family Leave, Minimum Wage*
Is a new poster required?
The updates listed above are mandatory and must be posted, except for the minimum wage changes in Montana, South Dakota, and Washington. These states provide an updated minimum wage poster, but posting it is not required under state law.
Displaying the latest pay information is always a good idea, however, and is an effective way for employers to make workers aware of the state's minimum wage rate. It also shows that employers are aware of the new rate and are on top of updates to state laws.
Minimum wage updates already on some state posters
Employers should note that a few states with minimum wage changes in 2024 don’t require a poster update if they already have the most recent version of the poster on display. In these states, rates for multiple years are listed on the poster and the 2024 rate is already shown:
- Delaware
- Hawaii
- Nebraska
What if I don’t update my poster?
If a required posting update is not displayed, there is the possibility of a fine from a state agency. In addition, failing to display the poster could give employees additional time to file a lawsuit because they were not made aware of their rights.
Updating posters is also an effective way to show that an employer pays attention to details and is diligent about compliance.
Key to remember: Posting updates are often required at the beginning of the year. Employers should prepare now by being aware of required changes and make a plan for getting the updated posters on the wall.
